A trustee has fiduciary duties, which are legal obligations to administer trust property for the beneficiaries rather than for personal advantage. Depending on the circumstances, these duties may include loyalty, prudent administration, impartial treatment, protection of trust property, accurate recordkeeping, and compliance with the trust’s terms.

A trust accounting records assets, receipts, expenses, distributions, and other transactions during a particular period. Incomplete records can make it difficult to answer beneficiary questions or explain the basis for a trustee’s decision.

The processes may also overlap when a will directs estate assets into the trust, creditors submit claims, title issues remain unresolved, or beneficiaries challenge the handling of property.
