Revocable Living Trusts

Norman Revocable Living Trust Attorney

Revocable Trust Guidance Backed by Over 35 Years of Collective Experience

A revocable living trust can place selected property within a structure you control during your lifetime. You can name a successor trustee to manage trust property if you can’t and provide instructions for administering it after your death. The trust generally remains changeable while you retain the legal authority to amend or revoke it. Whether this tool fits your needs depends on your assets, family circumstances, intended beneficiaries, and broader estate plan.

What a Revocable Living Trust Can & Can’t Do

A living trust can address property management during your lifetime, planning for incapacity, and the eventual transfer of assets held by the trust.

Depending on its terms and coordination with your estate plan, a revocable trust can help you:

  • Retain control: Serve as trustee and manage trust property during your lifetime.
  • Prepare for incapacity: Authorize a successor trustee to manage trust assets if you become unable to act, subject to the trust terms and applicable law.
  • Direct administration: Establish instructions for managing and distributing trust property after your death.
  • Limit probate: Allow properly titled trust assets to pass through trust administration instead of probate in appropriate circumstances.
  • Organize distributions: Set terms for property intended for minor beneficiaries or other family members.

Probate avoidance isn’t automatic. Property left outside the trust may require another transfer method and could remain subject to probate. Beneficiary designations, joint ownership, and transfer-on-death arrangements can also determine how individual assets pass.

When Norman Residents May Consider a Living Trust

A revocable living trust may be worth considering if you own real property, hold several kinds of assets, or want continuity in property management during incapacity. It may also be useful when planning for minor beneficiaries, a blended family, out-of-state property, business interests, or changing family relationships.

A trust isn’t the right choice for every estate. A will, financial power of attorney, advance health care directive, and properly completed beneficiary designations serve separate purposes. Irrevocable trusts and special needs trusts also address different objectives and shouldn’t be treated as substitutes for a revocable trust without careful legal guidance.
